By accessing our website, placing an order, approving a design, or purchasing our products, you agree to these Terms & Conditions. Please review them carefully before making a purchase.

Products & Services

DŪSTAR Apparel offers a variety of apparel, headwear, accessories, custom-decorated merchandise, and related products.

Many of our products are made to order, customized, personalized, or produced specifically for individuals, teams, businesses, schools, and organizations.

We make every effort to accurately display product descriptions, colors, sizes, specifications, and pricing. However, actual product colors may vary slightly due to screen settings, lighting, manufacturing differences, and decoration methods.

Product availability, specifications, and offerings may change without notice.

Orders & Acceptance

By placing an order, you agree that:

• All information provided during checkout is accurate and complete.
• You have reviewed the product descriptions, quantities, sizes, colors, and any personalization details.
• You are authorized to use the payment method provided.
• You understand that custom and made-to-order products may have different production times and return restrictions than standard merchandise.

An order confirmation acknowledges receipt of your order but does not guarantee that every item is available or that the order can be fulfilled.

We reserve the right to decline or cancel orders due to product unavailability, pricing errors, suspected fraud, unauthorized artwork, or other legitimate business reasons.

If we cancel an order after payment has been collected, we will issue a refund for the canceled items.

Custom Orders & Artwork Approval

Custom apparel and decorated merchandise may require customer approval before production begins.

When an artwork proof, digital mockup, or product presentation is provided, the customer is responsible for reviewing and approving all details, including:

• Spelling, grammar, names, and numbers
• Artwork placement, dimensions, and orientation
• Product styles, sizes, quantities, and colors
• Decoration methods and design specifications

Approval confirms that the customer has reviewed and accepted the presented design and specifications.

Once artwork has been approved and production has begun, changes or cancellations may not be possible.

DŪSTAR Apparel is not responsible for errors that were clearly represented in an approved proof, except where required by applicable law.

Digital mockups are visual representations of the finished product. Minor differences in color, placement, texture, and appearance may occur during manufacturing and decoration.

Customer-Provided Artwork

By submitting logos, graphics, artwork, photographs, text, or other materials for reproduction, you confirm that you own the materials or have the necessary permission to use and reproduce them.

You authorize DŪSTAR Apparel to reproduce, modify as necessary for production, and apply these materials to products purchased through us.

Customers are responsible for obtaining any necessary licenses, permissions, or approvals involving trademarks, copyrights, or other intellectual property rights.

We reserve the right to refuse artwork that we reasonably believe infringes intellectual property rights or violates applicable laws.

Pricing & Payment

All prices are listed in U.S. dollars unless otherwise indicated.

Applicable sales taxes, shipping charges, and other fees will be calculated or disclosed during checkout or included in an approved quote or invoice.

Payment may be required in full before production begins unless alternative payment arrangements have been agreed upon.

For orders involving deposits, partial payments, or invoicing, the applicable payment terms will be provided on the quote, invoice, or order confirmation.

We reserve the right to correct pricing or calculation errors before fulfilling an order. If a correction affects an order that has already been paid, we will contact you before proceeding and provide the option to cancel for a refund.

Payments may be processed through secure third-party payment providers. DŪSTAR Apparel does not control the independent policies or processing times of those providers.

Presales & Group Orders

Certain products may be offered through presales, team stores, organization stores, fundraisers, or limited ordering periods.

Presale products are generally collected during a designated ordering window and may not enter production until the ordering period has ended.

Some presales require a minimum number of orders or a minimum production quantity before the products can be manufactured.

If a required minimum order quantity is not met, the affected presale will be canceled, and customers will receive a full refund of their affected purchases, including applicable taxes and associated shipping charges.

Additional presale conditions include:

• Presale products may not be immediately available for shipment.
• Production and fulfillment generally begin after the ordering deadline and confirmation that any required minimum has been met.
• Estimated production and delivery timelines will be communicated when available.
• Presale ordering deadlines may limit opportunities for changes or cancellations.
• Orders placed during a presale are subject to the specific terms disclosed on the product page or at checkout.

If a presale is canceled, refunds will be issued to the original payment method whenever possible. The time required for the funds to appear may vary depending on the payment provider or financial institution.

If a presale meets its minimum quantity but fulfillment is subsequently delayed or becomes impossible, customers will be provided the cancellation and refund rights required by applicable law.

Production & Processing Times

Production times vary based on product availability, decoration method, order quantity, customization requirements, and current production schedules.

Estimated production times are not guaranteed delivery dates unless expressly stated otherwise.

Orders requiring artwork approval, personalization details, sizing confirmation, or other customer-provided information may not enter production until all necessary information has been received.

Supplier shortages, equipment issues, shipping disruptions, or other circumstances outside our reasonable control may affect production schedules.

If an order cannot be shipped within the applicable promised timeframe, we will provide the notices, cancellation options, and refunds required by law.

Shipping & Delivery

Shipping options, charges, and estimated delivery times will be communicated during checkout or through the applicable quote or invoice.

Shipping transit times are separate from production and processing times.

Once an order has shipped, tracking information will be provided when available.

Customers are responsible for providing complete and accurate shipping information.

DŪSTAR Apparel is not responsible for delays caused by carriers, severe weather, service interruptions, or incorrect shipping information supplied by the customer. However, this does not limit any rights or remedies available under applicable law.

Local Pickup & Organization Delivery

Certain orders may qualify for local pickup, coordinated team distribution, or delivery to a designated organization or representative.

Pickup and delivery arrangements will be communicated when the order is ready.

For orders distributed through a team, school, business, or organization, the designated representative may be responsible for distributing merchandise to individual purchasers.

Once products have been delivered to or accepted by an authorized organization representative, the organization may assume responsibility for subsequent internal distribution.

Customers should follow the pickup or delivery instructions provided with their order.

Returns, Exchanges & Refunds

Because many DŪSTAR Apparel products are customized or made to order, certain items may not be eligible for return or exchange due to incorrect size selection, change of preference, or buyer's remorse.

Customers are responsible for reviewing size charts, product descriptions, and order details before completing their purchases.

If an item arrives damaged, defective, or materially different from what was ordered, please contact us so we can evaluate the issue and determine an appropriate resolution.

Approved refunds will generally be issued to the original payment method.

Presale cancellations resulting from unmet minimum order requirements are eligible for a full refund as described above, regardless of standard custom-product return restrictions.

Order Changes & Cancellations

If you need to change or cancel an order, please contact us as soon as possible.

We will make reasonable efforts to accommodate requests before materials have been ordered or production has begun.

Once an order has entered production, been personalized, or been submitted to a third-party production provider, changes and cancellations may no longer be possible.

Any approved cancellation may be subject to costs already incurred, where disclosed and permitted by applicable law.

These restrictions do not override cancellation or refund rights provided by law or the specific terms of an applicable presale.

Intellectual Property

All original website content, branding, graphics, text, photographs, product presentations, and designs created and owned by DŪSTAR Apparel are protected by applicable intellectual property laws.

Unless otherwise agreed in writing, purchasing a product or custom design service does not automatically transfer ownership of DŪSTAR Apparel's original artwork, design files, or other intellectual property.

Customer-owned trademarks, logos, and artwork remain the property of their respective owners.

You may not reproduce, distribute, sell, or commercially use DŪSTAR Apparel's proprietary content without prior authorization.

Website Use

You agree to use our website and services only for lawful purposes.

You may not:

• Submit fraudulent orders or payment information.
• Attempt to interfere with the operation or security of our website.
• Use our services to violate intellectual property rights.
• Upload malicious software or engage in unauthorized access.

Product Warranties & Limitations

We strive to provide high-quality products and accurate decoration services.

Normal variations in garment manufacturing, sizing, fabric texture, print placement, and color reproduction may occur.

To the extent permitted by law, DŪSTAR Apparel does not provide warranties beyond those expressly stated in our product descriptions, written agreements, or applicable policies.

We are not responsible for damage resulting from improper washing, drying, ironing, misuse, or failure to follow manufacturer care instructions.

Nothing in this section excludes warranties or legal remedies that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by applicable law, DŪSTAR Apparel and The Davey Group, LLC will not be liable for indirect, incidental, special, or consequential damages arising from the use of our website or the purchase of our products.
